No, they don't. The defender had less than 36 health points and that's why the first shot was deadly. You can kill a person no matter where you are aiming, provided that you inflict enough damage.

I had someone that kept challenging me to duel and I lost everytime. This happened 5 times in 2 days all they kept winning from me was $5 or $10 at a time. Then one day I changed my settings and won the duel and took $296 from him. Made me feel real good and he hasnt' come back since.
