No, they don't. The defender had less than 36 health points and that's why the first shot was deadly. You can kill a person no matter where you are aiming, provided that you inflict enough damage.

Actually he had exactly 36 HPs. That is why he passed out with 36 damage. You can never do more than their total available HPs.
